1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the ViewUpAI website at viewupai.com, our web application, desktop application, and related services (collectively, the "Service") operated by ViewUpAI ("ViewUpAI," "we," "us," or "our").

By creating an account, purchasing credits, downloading our software, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of the Service

ViewUpAI is an AI-powered interview copilot that provides real-time assistance during live interview calls, including features such as translation, answer suggestions, session support, and related tools designed to help you communicate more confidently during job interviews.

The Service is provided on a credit-based basis. Certain features require an active account, sufficient credits, and a stable internet connection. Availability of features may vary between our web and desktop applications and may change over time.

3. Eligibility

You must be at least 18 years old and capable of entering into a binding contract to use the Service. By using ViewUpAI, you represent that you meet these requirements and that all registration information you provide is accurate and current.

4. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly at support@viewupai.com if you suspect unauthorized access.

We may suspend or terminate accounts that violate these Terms, pose security risks, or are used in a manner that could harm ViewUpAI, other users, or third parties.

5. Credits, Billing, and Payments

ViewUpAI uses a credit system. Credits are consumed when you use eligible features of the Service, such as live copilot sessions, according to the rates displayed at the time of purchase or use.

Payments are processed through third-party payment providers. By completing a purchase, you authorize us and our payment partners to charge your selected payment method for the applicable fees, taxes, and charges.

Except where required by applicable law, all credit purchases are final and non-refundable once credits have been delivered or used. Unused credits may expire or remain in your account according to the terms shown at checkout or in your account dashboard.

6. Acceptable Use

You agree to use ViewUpAI lawfully and responsibly. You are solely responsible for determining whether your use of AI assistance is permitted in a given interview, assessment, employer process, academic setting, or jurisdiction.

You must not use the Service in any way that violates applicable laws, regulations, contractual obligations, employer policies, platform rules, or the rights of others.

• Misrepresent AI-generated content as solely your own original work where disclosure or prohibition applies
• Use the Service to cheat, defraud, harass, discriminate, or impersonate another person
• Attempt to reverse engineer, scrape, overload, or interfere with the Service or its infrastructure
• Upload, transmit, or store unlawful, harmful, or infringing content
• Share account access or resell credits or access to the Service without authorization
• Use the Service in high-risk environments where failure could lead to death, personal injury, or severe property or environmental damage

7. AI and Service Limitations

ViewUpAI uses artificial intelligence and related technologies that may produce inaccurate, incomplete, outdated, biased, or inappropriate outputs. You must review and exercise independent judgment before relying on any suggestion, translation, or other output.

We do not guarantee interview outcomes, job offers, hiring decisions, accuracy of translations, or uninterrupted availability of the Service. The Service is provided as a support tool only and does not replace your own preparation, judgment, or professional advice.

8. Intellectual Property

ViewUpAI and its licensors own all rights, title, and interest in the Service, including software, branding, design, documentation, and underlying technology, except for content you provide.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or internal business use in accordance with these Terms.

You retain ownership of content you submit to the Service. You grant ViewUpAI a worldwide, non-exclusive license to host, process, transmit, and display that content solely to operate, maintain, improve, and secure the Service.

9. Privacy

Our collection and use of personal information is described in our Privacy Policy at viewupai.com/privacy. By using the Service, you acknowledge that we will handle information as described in that policy.

10. Third-Party Services

The Service may integrate with or rely on third-party services such as authentication providers, payment processors, cloud infrastructure, analytics tools, and communication platforms. Your use of those services may be subject to separate terms and privacy policies.

ViewUpAI is not responsible for third-party services we do not control.

11. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, error-free, or free of harmful components.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIEWUPAI AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO VIEWUPAI FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) USD $100.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

13. Indemnification

You agree to defend, indemnify, and hold harmless ViewUpAI and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your content, or your violation of these Terms or applicable law.

14. Suspension and Termination

You may stop using the Service at any time. We may suspend or terminate your access immediately if you breach these Terms, create risk for us or others, or where required by law.

Upon termination, your right to use the Service ends. Provisions that by their nature should survive termination will survive, including payment obligations, intellectual property, disclaimers, limitations of liability, and indemnification.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice by posting the updated Terms on viewupai.com and updating the "Last updated" date above, or by other reasonable means.

Your continued use of the Service after the effective date of revised Terms constitutes acceptance of the changes.

16. Governing Law and Disputes

These Terms are governed by the laws applicable to ViewUpAI, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country of residence require otherwise.

Before filing a formal dispute, you agree to contact us at support@viewupai.com and attempt to resolve the issue informally. If a dispute cannot be resolved informally, it will be handled in the courts or forums specified by applicable law.
